The Law


All State, Local and Government agencies operating on the internet are subject to the law including but not limited to Section 508 and ADA Complaint. Also starting in 2018 selected service industry websites will also fall under these guidelines or be subjected to law suits and penalties.

The Attorney General has responsibility for publishing regulations implementing the requirements of title II (state and local government services) of the ADA. These regulations are now being implemented to companies with 15 or more employees that work for the benefit of the public on the internet.

What Is ADA Compliance Law


The Americans with Disabilities Act of 1990 (ADA) prohibits discrimination and ensures equal opportunity for persons with disabilities in employment, State and local government services, public accommodations, commercial facilities, and transportation. It also mandates the establishment of TDD/telephone relay services. The ADA was revised by the ADA Amendments Act of 2008 (P.L. 110-325), which became effective on January 1, 2009. The ADA is codified at 42 U.S.C. 12101 et seq.

What Will Happen?

YYou will receive a letter from a lawyer or some governing body that is informing you that your website is not ADA Complaint. They will inform you that you have ‘x’ amount of days to comply and in some cases provide a company to contact that will help you with your remediation. If you do nothing and the deadline pass that you were given to make it compliant they will file the suit in court. They may request your site come down until it can pass an ADA compliance scan. You will have to make the web site compliant either way on top of being sued.

Does this affect me?

YES any industry that provides a service to the public or information to the public is affected by the law that includes all local, state or government agencies. Some examples of industries that get the most ADA lawsuits filed against them are Community Banks (dandodiary.com) and Restaurants (modernrestaurantmanagement.com).
